SMSL RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY
As a participant in the SPRINGFIELD MEN’S SOCCER LEAGUE (SMSL) (“Activity”), I, for myself for personal representatives, assigns, heirs, and next of kin:
1. ACKNOWLEDGE, agree, and represent that I understand the nature of the Activity and that I am qualified, in good health, and in proper physical condition to participate in such Activity. I further agree and warrant that if at any time I believe conditions to be unsafe, I will immediately discontinue further participation in the Activity.
2. FULLY UNDERSTAND THAT (a) THE ACTIVITY INVOLVES RISKS AND DANGERS OF SERIOUS BODILY INJURY, INCLUDING PERMANENT DISABILITY, PARALYSIS, AND DEATH ("RISKS"); (b) these Risks and dangers may be caused by my own actions or inactions, the actions or inactions of others participating in the Activity, the condition in which the Activity takes place, or THE NEGLIGENCE OF THE "RELEASEES" NAMED BELOW; (c)there may be OTHER RISK AND SOCIAL AND ECONOMIC LOSSES either not known to me or not readily foreseeable at this time; and I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES I incur as a result of my participation In the Activity.
3. HEREBY RELEASE, DISCHARGE, AND COVENANT NOT TO SUE the Springfield (IL) Park District, referees contracted to officiate the Activity games, and the SMSL their respective administrators, directors, agents, officers, members, volunteers, and employees, other participants, any sponsors, advertisers, and, if applicable, owner and lessor of premises on which the Activity takes place, (each considered one of the "RELEASEES" herein) FROM ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON MY ACCOUNT CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE "RELEASEES" OR OTHERWISE, INCLUDING NEGLIGENT RESCUE OPERATIONS AND I FURTHER AGREE that if, despite this RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT I, or anyone on my behalf, makes a claim against any of the RELEASEES, I WILL INDEMNIFY,SAVE, AND HOLD HARMLESS EACH OF THE RELEASEES from any litigation expenses, attorney fees, loss, liability, damage, or cost which may incur as the result of such claim.
COVID-19 WAIVER
SMSL cannot prevent you [or your child or children] from being exposed to, contracting, or spreading COVID-19 while participating in a RECREATIONAL ACTIVITY or entering upon or using facilities utilized by the SMSL. It is not possible to prevent against the presence of the disease. Therefore, if you choose to or consent to your child or children participating in a RECREATIONAL ACTIVITY or entering upon or using SMSL utilized facilities, you or your child or children may be exposing yourself or them to and/or increasing your or their risk of contracting or spreading COVID-19.
By my signature or initials, I understand personally and on behalf of my child or children the foregoing, and assume all risk that by participating in the RECREATIONAL ACTIVITY and/or entering upon or using SMSL utilized facilities, I and/or they may contract or spread COVID-19. I acknowledge and agree that my or my minor child or children’s participation in the RECREATIONAL ACTIVITY is voluntary and that there is a potential risk of exposure of myself/my minor child to illness including COVID-19 in so participating. I also understand that the SMSL cannot guarantee that myself/my minor child will not be exposed or contract illness including COVID- 19 while this participating in this RECREATIONAL ACTIVITY.
I fully understand my/my minor child’s participation involves risks and that his/her/their participation in the RECREATIONAL ACTIVITY is of such value to me and/or them that I fully accept all risks of such participation and assume sole responsibility for any and all losses, illnesses, injuries, costs and damages they or I incur as a result of their or my
VOLUNTARY participation in the RECREATIONAL ACTIVITY. This release is intended to release and discharge in advance the SMSL (its directors, officers, employees, volunteers, referees and agents) of and from any and all liability arising out of or connected in any way with my child or children’s or my VOLUNTARY participation in said RECREATIONAL ACTIVITY. I also agree that I and/or my minor child or children will stay home and not participate in the RECREATIONAL ACTIVITY or enter upon facilities should I or he, she, or they show any symptoms of illness including cough, fever, or similar flu-like symptoms in advance of any RECREATIONAL ACTIVITY.
SMSL PLAYER AND SPECTATOR CODE OF CONDUCT
The following “Player’s Code of Conduct” has been adopted by the SMSL and Park District.
These rules of conduct will apply to all players, managers and spectators and will be strictly enforced in all practices, games, and tournaments.
1. NO PLAYER OR SPECTATOR SHALL: At any time lay a hand upon, shove, strike, or threaten an official or SMSL staff member, volunteer or participant.
2. NO PLAYER OR SPECTATOR SHALL: Refuse to abide by an officials decision.
3. NO PLAYER OR SPECTATOR SHALL: Be guilty of an objectionable demonstration of dissent at an official’s decision.4. NO PLAYER OR SPECTATOR SHALL: Discuss with an official, in any manner, the decision reached by such official, except the manager or captain.
5. NO PLAYER OR SPECTATOR SHALL: Be guilty of using unnecessarily rough tactics in the play of the game against the body or person of an opposing player.
6. NO PLAYER OR SPECTATOR SHALL: Be guilty of physical attack as an aggressor upon any player, official, or spectator.
7. NO PLAYER OR SPECTATOR SHALL: Be guilty of an abusive verbal attack upon any player, official, or spectator.
8. NO PLAYER OR SPECTATOR SHALL: Appear upon the field/court of play at any time in an intoxicated condition.
9. NO PLAYER OR SPECTATOR SHALL: Use profane, obscene or vulgar language or gestures at any time.
10. NO PLAYER OR SPECTATOR SHALL: Smoke while coming off or going on the field of play, or while on the field of play.
11. No alcoholic beverages of any kind are allowed on the field. Players are not allowed to consume alcohol in the spectator area while their game is being played.
12. No manager, team captain, or team representative shall, at any time, falsify the identification of any player or person on an official league, game, or tournament sports roster, such falsification, intentional or otherwise, and with or without that player or person’s knowledge, shall be just cause for disciplinary action.
13. Any player removed from a game must leave the facility immediately (out of sight and out of sound). Failure to do so will result in further suspension.
14. Appeals to any violation may be lodged with only the SMSL Board which will decide the matter.
15. Officials are to be interpreted as game referees, assignor, or Board member.
16. ALL MANAGERS/Captains ARE HELD RESPONSIBLE FOR THEIR PLAYERS’ ACTIONS OF PLAY, KNOWLEDGE OF LEAGUE RULES, PLAYER CONTRACTS, AND KNOWLEDGE OF THE “PLAYER CODE OF CONDUCT”.
